Terms of Service & Professional Representation Agreement
Notice: The following terms govern your use of our site and public adjusting services. These policies are provided for informational clarity and administrative transparency. They do not replace formal legal counsel or supersede the specific, binding terms outlined in your signed Public Adjuster representation agreement.
-
Legal Entity & Governing Law
This website and its associated professional advocacy services are operated by Second Opinion Public Adjusters, LLC. By accessing our digital channels or engaging our firm, you agree that these terms are governed exclusively by the laws of the State of Texas, with venue recognized in Tarrant County courts, without regard to conflict of law principles.
-
Scope of Professional Representation
Second Opinion Public Adjusters acts as an independent advocate for residential and commercial policyholders. Our services encompass the analysis, assembly, and negotiation of property damage claims — including but not limited to fire, wind, hail, tornado, and water damage. We work exclusively for you, the insured, and proudly never represent the insurance company.
-
Licensing & Multi-State Authority
While our principal office is located in Fort Worth, Texas, we actively serve policyholders across multiple states including Texas, Oklahoma, New Mexico, Louisiana, Colorado, Georgia, and Florida. All services and claim adjustments are performed strictly within the boundaries of active multi-state licensing requirements in the jurisdiction where the loss occurred.
-
Payments & Appraisal Services
For administrative fees, appraisal services, or other specific flat-fee engagements, transactions may be processed securely via Stripe, Inc. Payment credentials are encrypted and handled directly by the processor upon customer authorization at checkout. We do not store full payment card details on our servers. Please note, we do not offer general subscriptions; our public adjusting services are purely project-based for individual insurance claims.
-
Refunds & Contingency Structure
Our core property damage claim representation is typically executed on a contingency-fee basis, meaning we are paid a predetermined percentage of the final insurance settlement as governed by your signed Public Adjuster contract. Due to the nature of this structure, standard refunds do not apply. Any upfront consultation or appraisal fees, if applicable, are handled as explicitly described in your specific engagement letter prior to work commencing.
-
Acceptable Use & Intellectual Property
Users must not engage in unlawful use, digital data scraping, or the intentional submission of fraudulent insurance claim information through our website. All content, including proprietary damage assessment frameworks, brand imagery, and educational materials regarding the insurance claim process, remains the exclusive intellectual property of Second Opinion Public Adjusters. Unauthorized duplication or commercial use is strictly prohibited.
